Welcome to Fretprints.com (“Fretprints,” “we,” “us,” or “our”), owned and operated by Hampstead Guitar, LLC. These Terms of Service (“Terms”) govern your access to and use of the Fretprints website located at fretprints.com, including all content, features, tools, and services available through it (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services.
1. About the Services
Fretprints is a subscription-based online membership platform providing jazz guitar education. The Services include, but are not limited to, video lessons, interactive exercises and drills (powered by Soundslice), written etudes, transcribed solos, an interactive fretboard application, backing tracks, PDF reference materials, a podcast, live coaching sessions, office hours, livestream replays, structured courses with progress tracking, a member community forum, and a member chat feature. The scope of Services may change over time as we add, modify, or retire features.
2. Eligibility
You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to create an account and subscribe to the Services. If you are between sixteen (16) and eighteen (18) years of age, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Services, you represent and warrant that you meet these eligibility requirements.
3. Account Registration and Security
To access the Services, you must create an account and provide accurate, current, and complete information during registration. You agree to update your information as necessary to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Your account is personal to you and may not be shared with, transferred to, or used by any other individual. You may not create multiple accounts, impersonate another person, use a false identity, or use an email address that does not belong to you. You agree to notify us immediately at jim@fretprints.com if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our discretion for any reason, including violation of these Terms.
4. Subscriptions, Billing, and Free Trials
4.1 Subscription Plans
Fretprints offers subscription-based access to the Services. Current plans include a Monthly subscription and an Annual subscription. Details regarding pricing for each plan are available on our membership page. All prices are listed in U.S. dollars and are subject to change.
4.2 Free Trial
We may offer a free trial period for new subscribers. If you sign up for a free trial, you will be required to provide a valid payment method. At the end of the free trial period, your selected subscription plan will automatically begin and your payment method will be charged at the then-current rate unless you cancel before the trial period ends.
4.3 Recurring Billing
By purchasing a subscription, you authorize Fretprints to charge your payment method on a recurring basis (monthly or annually, depending on your plan) at the then-current rate until you cancel. Subscription periods renew automatically on the anniversary of your original subscription or trial conversion date. If we change the price of your subscription, we will notify you by email in advance of your next renewal date.
4.4 Cancellation
You may cancel your subscription at any time from your account page. Upon cancellation, you will retain access to the Services through the end of your current paid billing period. No refunds or credits are provided for partial billing periods. There are no cancellation fees and no long-term contracts.
4.5 Payment Processing
Payments are processed by our third-party payment processor. Fretprints does not directly store your full credit card information. By providing payment information, you represent that you are authorized to use the payment method provided.
5. License to Use the Services
Subject to your compliance with these Terms and payment of applicable fees, Fretprints grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial educational use. This license does not include the right to sell, resell, reproduce, duplicate, distribute, publicly display, publicly perform, or otherwise exploit any content from the Services for any commercial purpose. You may not sub-license, rent, or lend your access to any third party.
6. Intellectual Property
6.1 Ownership
All content available through the Services — including but not limited to video lessons, audio recordings, written materials, PDF documents, musical notation, exercises, etudes, transcriptions, graphics, software, the interactive fretboard application, and website design and layout — is the property of Hampstead Guitar, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you under these Terms are reserved.
6.2 Restrictions
You may not reproduce, copy, download (except where expressly permitted for personal use, such as designated PDF materials), distribute, modify, create derivative works from, publicly display, publicly perform, republish, or exploit any content from the Services without the prior written consent of Fretprints. You may not use automated tools, bots, scrapers, or similar technology to access, extract, or index content from the Services.
6.3 Copyright Complaints
Fretprints respects the intellectual property rights of others. If you believe that content on the Services infringes your copyright, please contact us at jim@fretprints.com with a description of the copyrighted work, identification of the infringing material and its location, your contact information, and a statement made under penalty of perjury that you are authorized to act on behalf of the copyright owner.
7. User Conduct and Community Guidelines
Fretprints provides community features including a member forum, chat, and live sessions. When participating in any community feature or submitting content to the Services, you agree to the following:
(a) You will not post, transmit, or share content that is obscene, threatening, harassing, defamatory, hateful, discriminatory, or otherwise offensive or unlawful.
(b) You will not post content that infringes on any third party’s intellectual property rights, privacy rights, or other legal rights.
(c) You will not use the Services to advertise, promote, or solicit products or services unrelated to your personal use of the platform.
(d) You will not interfere with or disrupt the enjoyment of the Services by other members.
(e) You will not attempt to gain unauthorized access to any part of the Services, other users’ accounts, or any systems or networks connected to the Services.
(f) You will not upload or transmit viruses, malware, or any other harmful code.
(g) You will not use the Services for any illegal purpose or in violation of any applicable law or regulation.
Fretprints reserves the right to review, edit, or remove any user-contributed content at our sole discretion and without notice. We also reserve the right to suspend or terminate access for any member who violates these guidelines.
8. User-Submitted Content
By submitting content to the Services (including forum posts, chat messages, feedback submissions, playing recordings, or any other materials), you grant Fretprints a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, display, and distribute such content in connection with the operation and promotion of the Services. You represent that you own or have the necessary rights to any content you submit and that your content does not violate any third party’s rights. Fretprints is not responsible for the loss of any user-submitted content.
9. Educational Disclaimer
All content, information, advice, guidance, and recommendations provided through the Services are intended solely for general music education purposes. Fretprints does not guarantee any specific educational outcomes, musical proficiency, or career advancement as a result of using the Services. You acknowledge that musical development depends on many factors including individual effort, practice, and natural ability. Fretprints assumes no responsibility for results relating directly or indirectly to any action or inaction you take based on the information provided through the Services. If any content involves physical activity or technique, you are responsible for practicing safely and consulting a healthcare professional if you experience pain or injury.
10. Third-Party Services and Content
The Services may incorporate or link to third-party platforms, tools, and content, including but not limited to Soundslice (interactive notation), YouTube (embedded video), and third-party payment processors. Your use of these third-party services is subject to their respective terms of service and privacy policies. Fretprints is not responsible for the availability, accuracy, content, or practices of any third-party service and is not liable for any loss or damage arising from your use of such services. The inclusion of third-party links or integrations does not imply endorsement by Fretprints.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FRETPRINTS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FRETPRINTS DOES NOT WARRANT THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OR INFORMATION OBTAINED THROUGH THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAMPSTEAD GUITAR, LLC, ITS OWNER, AFFILIATES, INSTRUCTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF FRETPRINTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO FRETPRINTS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify, defend, and hold harmless Hampstead Guitar, LLC, its owner, affiliates, instructors, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use or misuse of the Services, (b) your violation of these Terms, (c) your violation of any third party’s rights, or (d) any content you submit through the Services.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved exclusively in the state or federal courts located in Carroll County, Maryland, or the United States District Court for the District of Maryland, and you consent to the personal jurisdiction of such courts. Before filing any claim, you agree to first contact us at jim@fretprints.com and attempt to resolve the dispute informally for at least thirty (30) days.
15. Modifications to the Services
Fretprints reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. This includes adding, changing, or removing content, features, tools, pricing, or scheduling of live sessions. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.
16. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website prior to the changes taking effect. The “Last Updated” date at the top of these Terms indicates when the most recent revisions were made. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Services and cancel your subscription.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Hampstead Guitar, LLC regarding your use of the Services, and supersede all prior agreements, understandings, and communications, whether written or oral.
19. No Waiver
The failure of Fretprints to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Fretprints.
